STALLION SERVICE AGREEMENT

THIS AGREEMENT is made and entered into on _____________________(date), by and between the following parties. Buzzards Roost Paloose, James A. &/or Lisa M. Supon, Wellington, Ks., hereinafter called “Stallion Owners”, and _______________________

___________________________ (Mare Owners Name) of ____________________________, (City/State), hereinafter called “Mare Owner”.

NOW THEREFORE, in consideration of the covenants and promises as hereinafter set forth, the parties do hereby agree as follows:

1. Mare Owner & Buzzards Roost Paloose agree to breed the mare named below to the stallion, C.L. SCOOTER, for a fee of $300.00 during the ______________(month/year) season. A non-refundable booking deposit of one-half (1/2) is payable upon execution of this breeding contract. This fee is applied toward the breeding fee. The remainder of the breeding fee $____________, together with all unpaid board and expenses will be paid before the mare is picked up. The mare will not be released until all fees incurred are paid in full.

2. Board charges are as follows: Mare care $6.00 per day/Wet $4.00 per day/Dry

3. Stallion Owners shall exercise his/her own judgment in caring for said mare &/or foal. Stallion Owners veterinarian may perform, at Stallion Owners discretion, any veterinarian services deemed necessary or appropriate at Mare Owner’s expense. These include, but are not limited to, worming, treating for infections, disease or accident-related conditions, preventive measures, original examination or farrier work.

4. The mare shall be healthy and in sound breeding condition, free from infection, contagious or transmissible disease. A current negative Coggins test, copy of Registration papers (front & back), plus worming and immunization records must accompany mare. If not supplied, the Stallion Owners veterinarian will examine, test and treat mare at mare Owners expense. Stallion Owner reserves the right to refuse said mare if not in satisfactory condition.

5. Stallion Owners will attempt with reasonable diligence to settle the mare. If however, the mare does not settle, Stallion Owners will be held harmless. The breeding season shall be from February 1^st until July 30^th, at which time all breeding will be discontinued.

6. Re-breeds will not be honored if mare leaves premises prior to a Twenty-one (21) day heat cycle.

7. Stallion Owners guarantees a live foal from the breeding contracted for herein. Should the mare not settle by the closing date or not produce a live foal (one that stands & nurses), Mare Owner shall be entitled to re-breed the same mare the following year on the terms and conditions provided in this agreement without payment of the breeding fee, but upon payment of board and all other expenses incurred. Failure to carry or produce a live foal is to be verified within a Seventy-two (72) hours by a licensed veterinarian. The right to re-breed will be of no further effects if the mare is taken to any other stallion before being re-bred to above named stallion, or if the Mare Owner fails to deliver the mare the following year for re-breeding. In either case, all fees may be forfeited and this contract becomes void.

8. Stallion Owners, veterinarians, farriers and any other parties involved shall be held harmless of liability for any loss from death, disease, sickness, injury, fire theft or other harm suffered by mare &/or foal regardless of how it may occur. Likewise, Mare Owner shall not be liable for death, disease, sickness of injury to stallion arising from services contracted for in this agreement.

9. This contract is non-transferable. Breeders Certificates will be issued when Mare owner notifies Stallion Owners of the birth of a foal and only after payment of all bills have been made in full. This is the entire agreement between parties; any amendments or modifications of terms must be in writing.
